Plaintiffs Seek Morcellator MDL over Cancer Claims 

Plaintiffs from at least two dozen lawsuits are seeking to centralize their cases against the manufacturers of power morcellators before one judge. This tactic, called a multi-district litigation, or MDL, consolidates cases that allege similar claims to expedite pretrial proceedings and eliminate duplicative discovery efforts. Allegations against the manufacturers include the failure of the manufactures to adequately warn patients of the risks morcellators pose in disseminating dormant, undetected uterine cancers, which may spread aggressively after the tool is used in hysterectomy and myomectomy procedures. A hearing over whether a morcellator MDL will be established is scheduled to take place in October 2015.
