Near-Death Morcellator Victims Granted Expedited Discovery in MDL
More and more lawsuits are being filed against Johnson & Johnson’s subsidiary Ethicon over its controversial medical device called a morcellator. These tools are used in gynecological procedures, but have been linked to spreading undetected uterine cancers in women. Many women with lawsuits centralized in the morcellator multi-district litigation (“MDL”) whose health is rapidly deteriorating prompted the Kansas district court, presiding over MDL, to issue an order giving discovery priority to such plaintiffs that are in extremis, or in dire health condition or near death. The next status conference on the MDL is scheduled for February 10, 2016, where more case-specific discovery issues are expected to be discussed.
