MDL Established for Johnson & Johnson’s Ethicon Power Morcellators

In one of the latest developments in the power morcellator litigation (lawsuits filed against makers of controversial gynecological devices claiming they may spread unknown, aggressive uterine cancer), the Judicial Panel on Multidistrict Litigation issued an order on October 15, 2015 creating an MDL for Johnson & Johnson-manufactured Ethicon morcellators. A multi-district litigation, or MDL as it is commonly referred, consolidates cases with similar claims pending in several federal courts under one umbrella to be set before one judge in one court—similar to a class, however each case remains its own individual lawsuit. The MDL mechanism aids in eliminating duplicative discovery and expediting pre-trial proceedings to move the case along more quickly and efficiently.

The Ethicon morcellator MDL has been consolidated and transferred to the District of Kansas before Judge Kathryn H.
