In August 2016, U.S. District Judge Eldon Fallon established guidelines that will determine which cases are selected for the Xarelto bellwether trials scheduled to begin in February 2017. The first case will be selected from plaintiffs aged 50-90 who filed their claims in Louisiana and allege they suffered gastrointestinal bleeding due to the blood thinner, while the second case will be one claiming brain bleeding that caused injury or death. The third case will be picked from claims filed in Mississippi federal court by individuals aged 40-80 alleging gastrointestinal bleeding, and the fourth case will be identical to the first, except that it will be selected from cases filed in Texas.
Currently, there are more than 6,400 lawsuits filed against Xarelto’s manufacturers Bayer and Johnson & Johnson as part of a multidistrict litigation (“MDL”) in the Eastern District of Louisiana.
