DePuy Hip Implant Recipients Not Part of Original Settlement Want Same Benefit

About 75% of recipients of Johnson & Johnson’s DePuy hip implants not covered by the November 2014 settlement are awaiting a hearing to determine the medical device manufacturer’s liability for safety failures and patient harm. The settlement, which could amount to $4 billion, only covers hip implant patients who underwent revision surgery as of August 2014—which accounts for roughly 8,000 of the 32,000 total U.S. hip replacement cases. The excluded population, who may not be able to undergo a revision surgery for various medical reasons or who underwent a surgery after the deadline passed, are otherwise entirely similar to those covered by the settlement. These patients also experienced hip implants that failed or led to metal poisoning, and therefore should be entitled to compensation for these serious health concerns caused by Johnson & Johnson.
