Consolidation of Xarelto Cases Under Consideration

A panel of federal judges meeting December 4, 2014 will determine whether patients who have already filed lawsuits claiming injury from Xarelto —and the hundreds more expected to be filed in the coming weeks—can be consolidated together under one judge. Consolidation of these cases is beneficial for time-saving and cost-cutting reasons, but the familiarity aspect also helps, as a judge who has prior experience with similar cases aids tremendously in the efficiency of consolidated proceedings. The proposed overseer of the consolidation, U.S. District Judge David Herdon of Illinois, is arguably very well-equipped to handle these types of cases, as he recently presided over the $650 million settlement of 4,000 cases with similar claims over Boehringer Ingelheim’s anti-coagulant drug Pradaxa.
