Philips CPAP Replacement May Extend into 2023

Almost 18 months have passed since the massive Philips CPAP/Bi-PAP machine recall, and many patients are still stuck without a solution to their defective breathing machine. Despite Philips’ initial estimation that repairs or replacements would be made within approximately one year, it now appears that this timeline will stretch into 2023.

The issue with these machines was not obvious to users prior to the recall because the problem rests inside the device.

The machines are designed to help regulate breathing and treat sleep apnea—a sleep disorder where breathing repeatedly stops and starts throughout the night. The recalled Philips machines contain a polyester-based polyurethane foam (known as PE-PUR), which lines the interior of the machines. This foam is designed to quiet the vibrations the machines make when is in use. The foam can break down over time, and as it degrades, tiny particles and potentially carcinogenic gases may be released into the machine that may cause harm if inhaled or ingested. The toxic particles and gases have been linked to adverse health conditions, such as respiratory disease, liver failure, and certain cancers.

A Double-Edged Sword

As consumers wait for repairs or replacement machines to be issued, some are potentially risking their heath along the way: by using the machines, they may be risking development of certain health issues, and by not using the machines, they may be risking the dangerous side-effects of sleep apnea. Lawsuits have been filed alleging that Philips knew about the problem for years but failed to warn consumers about the issues with the foam. Meanwhile, the FDA has received approximately 70,000 medical device reports concerning problems associated with the recalled machines.
