Mother of Premature Infant Alleges Injuries in Similac Formula Lawsuit

In a recent baby formula lawsuit filed in January 2022, the mother of a premature infant alleges that her son’s necrotizing enterocolitis (“NEC”) was caused by Abbott’s Similac cow’s milk-based formula. According to the lawsuit, the baby was fed Similac Neosure preterm formula in the NICU about a month after he was born. The lawsuit alleges that the baby developed severe complications after being fed the formula for just six days; his injuries resulting in short bowel syndrome. As a result, the child is underweight and will require a lifetime of gastrointestinal care.

Necrotizing enterocolitis is a condition caused by rapid decay of the intestinal walls, leading to perforations (holes). These holes can let bacteria into the abdomen and bloodstream, leading to severe infection. NEC may resolve on its own, but for some babies, it may require surgical intervention or lead to sepsis or even death.

Plaintiffs across the country have filed lawsuits claiming Abbott Labs (maker of Similac) and Mead Johnson (maker of Enfamil) failed to warn consumers and medical providers of the link between NEC and their cow’s milk-based baby formulas.  The products’ current labeling does not carry any warnings of the risk.
