Mead Johnson Sued Again over Infant’s Preventable Death due to NEC

Following the catastrophic death of an infant, the baby’s mother has filed a lawsuit for damages against baby formula manufacturer Mead Johnson. The grieving mother alleges that her son, who was born prematurely, developed a dangerous intestinal condition known as Necrotizing Enterocolitis, or NEC, after ingesting Enfamil baby formula while in the NICU. Her complaint includes six counts, including negligence, failure to warn, defective design, and wrongful death that contributed to this preventable tragedy.

The lawsuit, like many others that have been filed in recent months, claims that Mead Johnson marketed its cow’s milk-based formulas without warning parents, caregivers, and the medical community of the link between their formulas and NEC when given to premature infants. NEC is a serious condition marked by inflammation of the intestines and gut that causes tiny holes to develop in the intestinal wall. NEC can lead to infection, require surgery to repair, and can be fatal for some babies. Baby formula lawsuits hold that the companies knew—or should have known—that their cow’s milk-based formulas may cause death or significant injury to preterm babies. The lawsuits also hold that the companies should have issued warnings on the product labeling.
