Baby Formula Lawsuits Multiply as Plaintiffs Lawyers Seek Consolidation

Dozens of lawsuits have been filed in Illinois State Court against Abbott Labs and Mead Johnson—makers of Similac and Enfamil baby formulas—alleging that the cow’s milk-based products caused a dangerous medical condition in infants. Plaintiffs’ lawyers and defendants alike are now seeking consolidation before one judge in Madison County, Illinois. More than 30 lawsuits are pending in Illinois, where the companies are based.

The cows’ milk-based formulas are often given to preterm babies in the NICU to help them gain weight. However, families are now learning of the link between these formulas and the risk for developing necrotizing enterocolitis (“NEC”), an intestinal condition that may cause severe injuries and even death. Plaintiffs allege that Abbott and Mead Johnson were aware of medical research pointing to the link between the formulas and NEC in preterm infants but did not warn of the risks. 

Should the Enfamil and Similac formula lawsuits be consolidated, each case will still proceed on its own but the consolidated proceedings will eliminate duplicative discovery efforts.
