3M Earplugs Bellwether Trial Results in $7.1M Award
A jury awarded $7.1 million to three plaintiffs in the first bellwether trial in the 3M Combat Arms earplugs multidistrict litigation. The plaintiffs, former service members, claimed to have been injured by the company’s defective dual-ended earplugs.
The products at the center of the litigation are the Version 2 of the Combat Earplugs (CAEv2). They were supplied to the military from 2003-2015. The product defect may impact more than 2 million service members who were deployed between 2001 and 2015.
Almost 240,000 claims have been consolidated in the MDL. Two more bellwether trials are scheduled for May and June before different juries.
