Bellwether Trial in Zimmer Duron Hip Replacement Litigation
On May 6, 2015, the first bellwether federal trial in the Zimmer Duron Cup hip replacement multi-district litigation commenced. The case will serve as a model for future litigation for the approximately 400 lawsuits pending against Zimmer, which all similarly allege that the Duron Cup hip replacement is defective and harmful to patients’ health, as it is prone to falling out of place and causing device recipients to experience immense pain. Zimmer marketed its Duron Cup hip replacement as a superior medical device, due to its durability and range of motion, but after just one year on the market, numerous reports surfaced citing device failures and necessary corrective surgeries to replace the device.
